Arrested for Bird Droppings on Car – Shai Werts

There are some stories that sound incredible, unbelievable and a figment of someone’s crazed mind. Many people are still scratching their head over this real life horror story. For years we have heard stories that seemed completely made up but see what you think after seeing this event that happened to Shai Werts, star quarterback . for  the Georgia Southern University football team.

Werts was driving when stopped for allegedly speeding. As he was driving, he called the local dispatch and informed them to advise the officer that he was looking for a lighted space to pull over. Seeing the actions that often result to Black men, it is no wonder that he was careful about where he pulled over. His route was blocked by another deputy’s car on the highway and Werts offered NO resistance and was very cooperative and calm.

He was arrested and his car searched inside and out. Seeing some bird droppings on the windshield, a deputy of the Saluda County (SC) Sheriff’s office, Charles Allen Browder III tested the droppings for cocaine and got a positive test. Browder then arrested Werts, placed him in the patrol car. Browder asked what the substance was and Werts responded that it was bird droppings. To be clear, we are talking about food that has been through the bird, like can be found on probably millions of cars at any one time. How many of you could have been arrested for having a drop of bird droppings on your car?

Werts informed the Browder that he was not on drugs as he was a football player and subject to drug testing on a random basis. Werts maintained control during the entire event and did not react like Browder, the Saluda County Deputy.

Team rules required Werts to report the event to the University immediately which he did and according to practice was suspended from the team. This action could have put his entire career in jeopardy. He was booked in the County jail overnight. To really understand what happened, you need to watch the accompanying videos below.

There are several problems with this scenario,

  1. As a Black man, you have to try to have witnesses to any and all traffic stops. We have seen what happened in Windsor, Virginia to a Lieutenant in the United States Army who was stopped for a minor traffic violation, physically assaulted and pepper sprayed.
  2. The field tests used by the police are a low dollar item and subject to many false positive results as in this case with bird droppings and the possibility of windshield cleaner.
  3. We see the case of Rebecca Shaw who was arrested and jailed for 5 months because a vitamin pill gave a false positive. She remained in jail until her husband could raise bail money and it took another 7 months before the State Crime lab identified the pill as a vitamin as Shaw has insisted.
  4. No one knows how many cases have resulted in people being jailed, records and lives ruined because they could not raise bail money and were railroaded into a guilty plea. This should be an embarrassment to the entire United States of America.
  5. The current tests were developed decades ago and are not accurate. What ever happened to “innocent until proven guilty?” Are we satisfied with a test that can send a person to prison and yet be false?

Days after the charge, the State Crime Lab confirmed that the substance on the windshield was indeed bird droppings as Werts had insisted, repeatedly.  After Werts was charged he spent the night in jail and was suspended from the Georgia Southern football team.

An internal investigation by the Saluda County Sheriff’s Office cleared Browder of any wrongdoing. He faced no discipline for any of his actions.  He had previously received an oral warning for insubordination in March 2019 from the Saluda Sheriff’s Office.

Browder had worked for the Lexington County Sheriff’s Office and had resigned for conduct unbecoming an officer before joining the Saluda Department. All of this information was known as Browder had written on his application acknowledging that he made “some mistakes that I fully regret and have learned from. I was terminated from Lexington County for these mistakes and took full responsibility for them and was left without a job.”

Approximately 6 months after this grievous incident, January 20, Browder resigned from the Saluda County Sheriff’s Office.

As expected, this case ignited a fire storm over the accuracy of field drug tests. There are many substances that give a false field test for controlled substances. We see the treatment that a huge segment of the population is subjected to and considering the injustice these people receive in the justice system makes the hair on the back of your head stand up just contemplating the number of lives ruined over false drug field tests.

Georgia Southern QB arrested after cops think bird poop is cocaine

Georgia Southern quarterback Shai Werts has been cleared of a drug charge after police officers mistook bird poop for cocaine. The 21-year-old was pulled over by police officers in Clinton, South Carolina, for speeding on July 31. While sitting in the back of the patrol car, officers found ‘white stuff’ on the hood of Werts car. Werts said it was bird poop, but officers claimed the substance tested positive for cocaine. Werts was arrested, charged with possession of cocaine and suspended from the Georgia Southern University football team. On Thursday, prosecutors announced the charges were dropped after test results proved the substance was not cocaine. The suspension has now been lifted.

With so much riding on the actions of law enforcement, we see instances where the actions are detrimental to the citizens. A drug conviction can ruin a person’s career and life. Why then do we insist on destroying the everyday life of so many with inaccurate tests. We see people incarcerated for extended pesrriods of time for vitamins and other substances known to give false positive results. It is time to upgrade our testing and treatment of people.
